1. Introduction
Gradient HQ, Inc. dba Gradient ("Gradient," "we," "us," or "our") respects your privacy and is committed to protecting your personal data. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website trygradient.ai and use our AI fluency assessment platform (collectively, the "Service").
Please read this Privacy Policy carefully. By using the Service, you agree to the collection and use of information in accordance with this policy.
2. Our Roles
For candidate and assessment data, we process personal information on behalf of the hiring organization that invited you to complete an assessment. In that context, the hiring organization is the controller (or business) that decides how the data is used, and we act as its processor (or service provider). If you are a candidate and want to exercise privacy rights over your assessment data, please direct your request to the hiring organization; we will assist it in responding.
For information we collect through our own website and marketing activities, we act as the controller (or business).
3. Information We Collect
Personal Information
We may collect the following types of personal information:
- Name and contact information (email address, phone number)
- Account credentials
- Company and role information
- Assessment data and results
- Communication records between you and our team
Automatically Collected Information
When you access the Service, we may automatically collect:
- IP address and browser type
- Device information and operating system
- Usage data (pages visited, time spent, actions taken)
- Cookies and similar tracking technologies
4. How We Use Your Information
We use collected information for the following purposes:
- To provide, operate, and maintain the Service
- To administer and score AI fluency assessments
- To communicate with you about your account or the Service
- To improve and personalize user experience
- To analyze usage patterns and optimize platform performance
- To comply with legal obligations
5. AI Processing
Assessment interactions are processed and analyzed using artificial intelligence, including by third-party AI service providers that act on our behalf. These providers operate under contracts that prohibit them from using the data to train their models. We do not use personal information to train or fine-tune AI models — our own or those of third parties.
6. How We Share Your Information
We do not sell your personal information. We may share your data with:
- Hiring organizations: Assessment results and related data are shared with the company that invited you to complete an assessment.
- Service providers: Third-party vendors who assist in operating the Service (e.g., hosting, analytics).
- Legal compliance: When required by law, regulation, or legal process.
- Business transfers: In connection with a merger, acquisition, or sale of assets.
7. De-Identified Information
Where we create or maintain de-identified information, we maintain and use it in de-identified form, we maintain technical safeguards and business processes that prevent re-identification of that information, and we do not attempt to re-identify it.
8. Data Security
We implement appropriate technical and organizational measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the Internet or electronic storage is 100% secure.
9. Data Retention
We retain your personal information only for as long as necessary to fulfill the purposes for which it was collected, comply with legal obligations, resolve disputes, and enforce our agreements. In summary:
- Account data is retained while the account is active and for 90 days after closure, during which an export is available; it is then deleted from production systems.
- Application audit logs are retained for 24 months.
- Database backups are kept on a short rolling window, so deleted data also expires from backups automatically.
Specific retention periods may be governed by the agreement between us and the hiring organization, which controls where it differs.
10. Your Rights
Depending on your location, you may have the following rights:
- Access, correct, or delete your personal data
- Object to or restrict processing of your data
- Data portability
- Withdraw consent at any time
To exercise any of these rights, contact us at security@trygradient.ai. If you are a candidate, please direct requests about your assessment data to the hiring organization that invited you, as described in "Our Roles" above; we will assist it in responding.
11. Cookies
We use cookies and similar technologies to enhance your experience, analyze traffic, and for marketing purposes. You can control cookie preferences through your browser settings.
12. Children's Privacy
The Service is not intended for individuals under the age of 18. We do not knowingly collect personal information from children.
13. Changes to This Policy
